Conditions for Malaun Treaty

       On 15th May, a Treaty at Malaun was signed by Amar Singh Thapa and Colonel Ochterlony.  There were following conditions for Malaun Treaty-
            “Keeping in mind the high authority, character and ability for ruling the given territory by Amar Singh Thapa, the following conditions are accepted-
1-Kaji Amar Singh Thapa would vacate Rajgarh (Malaun) and would proceed for his Rajgarh (Nepal) with his army. His soldiers would take weapons, two guns, personal properties, flags with them. British will facilitate for every subordinate of Amar Singh Thapa going to Nepal with respect and safety.
2-Keeping in mind the brave character of Ranjor/Ranjur Singh Thapa, he is also allowed with same facility. Ranjor Singh will march with his 200 soldiers from Jaithok/Jaithak. These soldiers would take weapons, flags, one gun and personal property with them. Other 300 non army personnel (Bhardar) would be without weapons and can take personal property with them. There will be respectful facilities for them and every care will be taken for respect of women.
3- Kaji Amar Singh Thapa and Ranjor/Ranjur Thapa will have freedom to march to Nepal border at Saryu Rive through Thaneshwar, Haridwar, Nazibabad. They are free for going through other roads. Necessary arrangement will be done for loading and carrying their properties.
4- Kaji Amar Singh Thapa and Ranjor /Ranjur Singh Thapa are free for meeting anywhere.
5- Those soldiers of Nepal do not want to go back Nepal are free for joining the British army. Other soldiers who do not want to go back to Nepal and British government do not wish them to appoint in its Army would be there as war prisoners till there is treaty between Nepal Kingdom and British.
6- Amar Singh Thapa could stay at Malaun Fort till loaders reach there and after then he has to leave immediately.
7- Amar Singh Thapa will instruct soldiers at staying at Gurkha occupied Forts (Garhi) as Bheli (Arki), Sabathu, Morani, Jaithok/Jaithak, Jagatgarh, Ravain etc for vacating the Forts (Garhi) and they should hand over the Garhi to authorized British officials.  The soldiers of those Garhi could take personal properties safely but cannot take weapons till Governor General takes decision.
8- Amar Singh Thapa is ready for instructing Kaji Bakhtwar Singh that he immediately vacates Garhwal state and he should hand over all forts (Garhi) to authorized British officials. Soldiers of Garhwal can take personal properties and weapons with them for going to Nepal through Kumaon (Kali River). British Government would offer a ‘Pass’ and one peon for one month for travelling through Kumaon. “
                Separate Condition by Amar Singh Thapa
     Both the officials were  just to sign that the letter of Bamshah for Nepalese Residents of west region reached there through official. Amar Singh Thaap added following conditions after reading the letter as-
“Amar Singh Thapa would like to declare that he is signing treaty just for the better realtion with British. He accepted agreement because of suggestions from Bamshah and other Bhardar (Officials) of Kumaon. “
    The apprehension of Bamshah about Amar Singh Thapa came true. Amar Singh Thapa not only added the suggestion by Bamshah on treaty paper but also wrote a letter to the Nepal King. Amar Singh Thapa wrote to the King that he surrendered before British army as per the suggestions from Bamshah.
